Data stored in the Outscale system may be subject to export control restrictions under the International Traffic In Arms Regulations ("ITAR") or the Export Administration Regulations ("EAR"). For technical data and software controlled under ITAR, Foreign Persons (defined below) are not permitted to have access to such items unless an export license has been obtained or a license exception applies. For technology and software controlled under the EAR, restrictions may apply to Foreign Persons having access to such items depending upon the export classification of the item and the country involved. Other requirements may also apply to the export, reexport and retransfer of such items. The term "Foreign Person" means natural persons who are not U.S. citizens, U.S. permanent resident aliens or protected individuals under 8 U.S.C. 1324b(a)(3) and foreign entities not incorporated in the U.S.
